Allegation
As a registered Chiropodist/ Podiatrist (CH12480) your fitness to practise is impaired by reason of misconduct and/ or lack of competence, in that you:
1. On 22 September 2020, during an appointment with Patient 1:
a. Did not consider and/ or record diabetic risk stratification;
b. Did not recognise ulceration;
c. Inappropriately referred Patient 1 for nail surgery;
2. On 14 October 2020, during an appointment with Patient 2, did not complete a primary patient assessment.
3. On 10 November 2020, during an appointment with Patient 3:
a. Did not complete a primary patient assessment;
b. Did not complete a diabetic assessment;
c. Conducted an incomplete vascular assessment for a new patient with diabetes;
d. Did not record the reason for previous foot amputation;
e. Did not consider and/ or record diabetic risk stratification.
4. On 25 September 2020, during an appointment with Patient 4:
a. Did not conduct a sufficient vascular assessment;
b. Did not request a culture having identified an infection.
5. On 2 October 2020, during an appointment with Patient 4, failed to manage and/ or escalate Patient 4’s infections in that you:
a. Booked a further appointment with no active treatment plan;
b. Did not request and/or document a request for a further and/ or alternative course of antibiotics.
6. On 19 October 2020, during an appointment with Patient 9, did not make an onward referral to the Multi Disciplinary Team [“MDT”] and/ or [“IDC”] of Patient 9’s new diabetic foot
7. On 23 October 2020, during an appointment with Patient 9:
a. Did not document ulcer dimensions;
b. Did not created an adequate follow up plan;
c. Did not make further attempts to contact the Practice Nurse.
8. On 22 October 2020, during an appointment with Patient 13, did not investigate non-palpable pulses and/ or use a Doppler.
9. On 7 October 2020, during an appointment with Patient 17, did not complete a primary patient assessment.
10. On 21 October 2020, during an appointment with Patient 21, recorded “right 1stsubungual sepsis”, but did not request antibiotics and/ or put a plan in place to address the diagnosis.
11. On 30 September 2020, during an appointment with Patient 45, did not complete a primary patient assessment.
12. On 2 November 2020, during an appointment with Patient 50:
a. Did not complete a primary patient assessment;
b. Did not complete an adequate assessment of the presenting problem;
13. On 3 March 2020, during an appointment with Patient 51:
a. Did not use SOAP notes;
b. Recorded an inadequate description of ulceration, in that you:
i. Did not record wound features,
ii. Did not record other ulceration sites;
c. Did not record wound dimensions;
d. Created an inadequate care plan in that you requested a 3-month return for a high-risk patient with active ulceration.
14. On 2 March 2020, during an appointment with Patient 52:
a. Did not asses Patient 52’s right foot;
b. Provided an inadequate description of the nature/ appearance of ulcerations in that you did not record wound dimensions;
c. Did not discuss and/ or seek advice from the practitioner who had previously treated Patient 52;
d. Created an inadequate care plan in that you did not put safety netting in place.
15. On 24 February 2020, during an appointment with Patient 53:
a. Did not use SOAP notes;
b. Did not record dimensions of the suspected burn;
c. Did not adequately follow up suspected burn;
d. Did not provide adequate safety netting.
16. On 4 March 2020, during an appointment with Patient 54:
a. Did not use SOAP notes;
b. Did not carry out an annual diabetic assessment;
c. Did not consider and/or record diabetic risk stratification;
d. Did not consider and/ or record potential diagnosis, including but not limited to:
i. Charcot neuroarthopathy;
ii. Fracture;
e. Did not provide adequate safety netting.
17. Following an appointment on or around 5 March 2020 with Patient 57,
a. Did not make an appointment record on Patient 57’s file until 28 September 2020;
b. Incorrectly recorded that the appointment took place on 3 March 2020;
c. Did not include any detail of the appointment in the records.
18. Following an appointment on or around 5 March 2020 with Patient 58:
a. Did not make an appointment record on Patient 58’s file until 28 September 2020;
b. Did not include any detail of the appointment in the records.
19. Following an appointment on or around 5 March 2020 with Patient 59:
a. Did not make an appointment record on Patient 59’s file until 28 September 2020;
b. Did not include any detail of the appointment in the records.
20. Following an appointment on or around 5 March 2020 with Patient 60:
a. Did not make an appointment record on Patient 60’s file until 15 October 2020;
b. Incorrectly recorded that the appointment took place on 2 March 2020;
c. Did not include any detail of the appointment in the records.
21. On 15 June 2020 during a meeting, acted inappropriately in that you said words to the effect of, “nigger in a haystack”.
22. On 9 September 2020, when you were scheduled to shadow Person E completing nail surgeries, you:
a. Arrived at the clinic approximately 70 minutes late;
b. Left part way through one of the surgeries you were scheduled to observe;
c. Undermined Person E in front of a patient by saying words to the effect of:
i. Aren’t you going to give her more [anaesthetic],
ii. You need to tie your hair back;
d. Undermined Person E, by telling an unknown individual by telephone that Person E was not competent
23. On 6 October 2020, during a EMIS training session, you acted unprofessionally in that you:
a. Left part way through the training session.
24. On one or more occasions on unknown dates, you made incorrect claims or statements to colleagues, in that you said words to the effect of:
a. You had been employed to conduct a review of the Isle of Man Podiatry Department [“the Department”];
b. You had been employed to “turn the Department around”;
c. The Department was going to be closed;
d. Colleagues were going to lose their jobs.
25. Your actions in particular 24 above were dishonest, in that you intended to create a false impression of:
a. Your position within the Department;
b. The future of the Department.
26. On an unknown date, you told Person C that you could prescribe medication, when you are not registered as a prescriber with the HCPC.
27. Your actions in particular 26 above were dishonest in that you intended to create a false impression about your qualifications.
28. On one or more occasions made false claims to colleagues and/ or patients, in that you said:
a. On 26 February 2020, that you had carried out nail surgery for the Scottish Cycling team during the weekend;
b. On an unknown date during 2020, that you had spoken to Southern General Hospital in Glasgow about Glasgow going into lockdown, when the hospital had closed in 2015;
c. On an unknown date, that you were part of the Australian Air Ambulance, when this is not included on your CV;
d. On an unknown date, that you performed nail surgery for the Scottish Rugby team alongside your role on the Isle of Man;
e. In your application to join the Department, that you worked at Chester and Halton NHS Trust as a scrub nurse, when you do not hold a relevant qualification;
f. On an unknown date, that you had attended the Sochi Winter Olympics in 2014 as a member of the Australian Olympic curling team;
g. On an unknown date, that you had been a member of the British and Australian rowing teams;
h. On 23 October 2020, that you were “known for being a skin surgeon removing skin cancers” in Australia, when you do not hold a relevant qualification.
29. Your actions at any or all of particular 28 above were dishonest in that you intended to create a false impression about your knowledge and/or experience.
30. The matters set out in particulars 1 to 20 amount to misconduct and/or lack of competence.
31. The matters set out in particulars 21 to 29 amount to misconduct.
32. By reason of your misconduct and/ or lack of competence, your fitness to practise is impaired.
