Allegation
As a registered Occupational Therapist (OT34697) your fitness to practise is impaired by reason of your Misconduct and/or Health. In that:
1. On 29 October 2019, you arrived at your work placement, namely Malvern Community Hospital, smelling of alcohol.
2. You have a health condition as set out in schedule A.
3. Your actions at paragraphs 1 amount to misconduct.
4. By reason of your Misconduct and/or Health your fitness to practise is impaired.
Finding
Preliminary Matters
Hearing in private
- Mr Barnfield and Mr Short jointly made an application for the entire hearing to be conducted in private to protect the Registrant’s private life.
- The Panel accepted the advice of the Legal Assessor. She referred the Panel to the HCPTS Practice Note “Conducting Hearings in Private”. There is a general public interest in open justice, but the Panel has the discretion to hear all or part of the hearing in private to protect the Registrant’s private life.
- The Panel decided that it was appropriate to hear the entire case in private. The Panel is sitting as a Health Committee and the allegation under consideration is a health allegation. The Panel considered that all the matters it would be considering were intrinsically linked to the Registrant’s health. It was therefore appropriate to hear the entire case in private.
Order
Decision
- The Panel was satisfied that both parties have considered this matter carefully, with due respect to the need to maintain public confidence in the profession, and that it was in the public interest for the Voluntary Removal Agreement to be agreed.
- The Panel therefore agreed to the proposed Voluntary Removal Agreement.
