Finding
Hearing in Private
1. Ms Sampson made an application for the whole of the hearing to be conducted in private as this is a health case. She referred the Panel to Rule 10(1)(a) of the Health Committee Rules, which gives the Panel a discretion to proceed in private in order to protect the Registrant’s private life as the matters relate solely to her health.
2. The Registrant supported the application.
3. The Panel accepted the advice of the Legal Assessor and bore in mind the considerations set out in the HCPTS Practice Note ‘Conducting Proceedings in Private’. It was aware it was conducting a balancing exercise between the public interest in a public hearing, and the Registrant’s right to privacy in respect of her private health matters. The Panel determined that in these circumstances the Registrant’s right to privacy outweighed the public interest, and that the hearing should therefore be conducted entirely in private.
Order
ORDER: The Registrar is directed to annotate the HCPC Register to show that, for a period of 12 Months from the date that this Order takes effect (“the Operative Date”), you, Mrs Katie Davies, must comply with the following conditions of practice:
1.You must confine your professional practice to non 999 emergency response work;
2. You must place yourself and remain under the indirect supervision of a workplace supervisor, registered by the HCPC or other appropriate statutory regulator, and supply details of your supervisor to the HCPC within 14 days of starting employment;
3. You must follow your supervisor’s advice in relation to undertaking any practice development programme or other training or support in order to bring your clinical skills up to date;
4. You must have access to support from an occupational health professional and follow their advice with regard to managing your mental health;
5. You must inform your employer if you suffer a relapse of any of your mental health conditions and follow their advice.
6. You must work with your work place supervisor to ensure that a report is provided to the HCPC 14 days before this order is reviewed. The report should include any incidences where your mental health has impacted on your fitness to practise and what you have done to overcome these difficulties.
Notes
The Order imposed today will apply from 6 June 2024.
This Order will be reviewed again before its expiry on 6 June 2025.
